Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Hubble media intelligence platform ("Service") provided by Uppercase AS, a company registered in Norway ("Hubble", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Pilot Programme
The Service is currently offered as part of a limited pilot programme. During the pilot period:
- Features, availability, and performance may change without prior notice.
- The Service is provided on an "as is" and "as available" basis without any uptime or service-level commitments.
- We may discontinue or modify the pilot programme at any time with reasonable notice.
3. Account and Access
Access to the Service requires an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly of any unauthorised use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorised access to systems or data.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
- Resell, sublicense, or provide access to the Service to third parties without our written consent.
5. Intellectual Property
All rights, title, and interest in the Service — including software, design, logos, and documentation — remain with Hubble or its licensors. These Terms do not grant you any intellectual property rights in the Service beyond a limited, non-exclusive, non-transferable right to use it in accordance with these Terms.
You retain ownership of any data you upload to or create within the Service ("Customer Data"). You grant us a limited licence to process Customer Data solely to provide and improve the Service.
6. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the EU General Data Protection Regulation (GDPR) and the Norwegian Personal Data Act (personopplysningsloven). Where we process personal data on your behalf, we will enter into a separate Data Processing Agreement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Hubble shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising out of or related to the Service.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you have paid us for use of the Service during the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded by law.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Term and Termination
These Terms remain in effect for the duration of your access to the Service. Either party may terminate by providing thirty (30) days written notice. We may suspend or terminate access immediately if you breach these Terms.
Upon termination, your right to access the Service ceases. We will make your Customer Data available for export for a period of thirty (30) days following termination, after which it may be deleted.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least thirty (30) days in advance via the Service or email. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Norway. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Oslo, Norway.
For consumers within the EU/EEA, nothing in these Terms affects your statutory rights under mandatory consumer protection legislation in your country of residence.
